Operational Contract

01. The Multi-Node Contract

By accessing the Avonix Digital infrastructure, initializing a subscription, or deploying a protocol, you enter into a legally binding contract between yourself ("The User") and Avonix Digital ("The Platform"). This agreement governs all operational interaction with the multihub, its sub-modules, and the underlying data arrays.

02. Intelligence Protocols & Law 09-08

Avonix Digital provides high-tier lead discovery (ORBIT), CRM management (VANGUARD), and content synthesis (GHOSTWRITER). This data is generated via proprietary synthesis of public data nodes and third-party APIs.

• Informational "As-Is" Status: All lead data and AI-generated content are provided for informational purposes only. Avonix offers zero guarantees regarding the precision, contactability, or validity of any lead artifact or synthesized message.
• GHOSTWRITER Responsibility: The User holds sole responsibility for the final output of the GHOSTWRITER engine. You agree not to utilize synthesized content for spam, harassment, defamation, or any activity that violates the CAN-SPAM Act or equivalent global regulations.
• Voice DNA Rights: By providing writing samples for Voice DNA calibration, you affirm that you own the rights to such content or have the explicit permission of the author. You may not upload content belonging to third parties for the purpose of stylistic imitation without consent.
• Regulatory Compliance (Morocco): In alignment with Law No. 09-08, User acknowledges that direct marketing via electronic means requires Prior Informed Consent.
• User Responsibility: The User holds total liability for obtaining necessary permissions and complying with CNDP guidelines when utilizing lead data or GHOSTWRITER outreach.

03. Limitation of Liability

The platform executes complex autonomous tasks. Avonix Digital shall not be held liable for:

• Operational Noise: Any negative reputation, blacklisting (e.g., DNSBL), or platform bans (LinkedIn, Gmail, etc.) resulting from the User’s deployment of lead data or outreach protocols.
• Financial Reverberations: Direct or indirect financial losses, missed conversions, or overhead costs incurred during platform downtime or logic errors.
• Total Cap: To the maximum extent permitted by Moroccan law, total liability is capped at the amount paid by the User for the active protocol during the single billing cycle in which the incident occurred.

04. Subscription Finality (Refund Policy)

Due to the high computational costs associated with high-tier lead generation and neural synthesis iterations, all sales processed via the Avonix multihub are final.

• Cancellation Node: Subscription cancellations prevent future billing at the end of the current operational term.
• No Prorated Refunds: Initializing a billing cycle commits the resources for that duration; therefore, no prorated refunds are issued for unused time within a cycle.

05. Code & Operational Integrity

All aesthetic layers, algorithms, and logic nodes found within Avonix are proprietary property.

• API Key Security: Users are responsible for the security and usage costs of the API keys they provide for ORBIT and GHOSTWRITER protocols. Avonix is not liable for unauthorized billing on your external AI accounts resulting from key mismanagement.
• Scraping or "harvesting" the multihub's own UI/UX, CSS arrays, or internal API responses is strictly prohibited.
• The use of automated bots to create accounts or bypass subscription logic is a breach of contract.
• Fair Use Policy: We reserve the right to throttle or terminate nodes that exhibit inhuman polling behavior or API abuse.
• Reverse-engineering the synthesis logic or bypassing the Orbital polling architecture will result in an immediate and permanent hardware-level ban.
